Every non government organization in India requires a legal entity such as trust deed/ Memorandum of Understanding(MOU’s)/Articles of Association(AoA’s) that consists the address and name of the non government organization, goals, details of legal main managing committee members, human resource and staffing or by any kind of staffing agencies, administrative laws, rules and regulations and procedures. There is no legal foundation for a trust to obtain permission; if the Trust wants to attain income tax exemptions or if it is based in a state that is run by the Public Trusts Act, trust registration, for example, Maharashtra.

Documents required for registration of Trust Act 1882 :

There is the requirement of details regarding the trustees like Name, Occupation, Address, Age, Father’s Name, Designation, Mobile Number, Email Address and Two Photograph.

Address Proof of Trustee & Settler required: – Aadhar Card/Voter I.D / Driving license / Passport or any other kind of address proof.

Electricity Bill or House Tax Receipt or Water Bill Receipt or Ownership Proof of Property required.

In the case of Rented, Rent Deed duly notarised with rent receipt and NOC form Land Lord on Stamp Paper along with Name of Landlord, Father’s name, Residence Address is required.

Presence of Settler required at the time of Registration along with Original Aadhar Card.

Physical Presence of Two witnesses with original Aadhar Card Proof at the time of Registration.

A group of eight or more people can be termed as a society. Its establishment is complex in comparison to trust, but it also affords more flexible nature in terms of rules.

The documents required for the registration of a society under Indian Society Act‘ 1860 are:-

Copy of PAN Card,

Proof of Permanent Address,

Memorandum of Association copies,

Copy of Articles of Association,

A covering letter,

Proof of Registered Address,

List of all the members included in the legal document,

A self- declaration.

An association that is established under an act by the Parliament of India governed on Indian Company Law for the upliftment of charity, religion or commerce can be registered as a company. All profits should be utilized for the objectives of the company.
